*General Terms and Conditions
These Terms and Conditions apply to and set out how Velocity members can earn Velocity Points on Eligible Purchases at 7-Eleven stores in Australia (7-Eleven Partner Program).
1. DEFINITIONS
Unless the context otherwise requires, in these 7-Eleven Partner Program Terms and Conditions (Terms and Conditions) the following terms shall apply. Capitalised terms not defined in this document will have the same meaning as in the Velocity Frequent Flyer Terms & Conditions of Membership.
“7-Eleven” means 7-Eleven Stores Pty Limited (ACN 005 299 427)
"Eligible Purchase" is a purchase transaction at a 7-Eleven store that meets all of the following conditions:
(a) the purchase price of the transaction (which will be used for awarding Velocity Points) will exclude the following items:
(i) tobacco and tobacco related products including but not limited to lighters;
(ii) parcel delivery and collect services including ParcelMate parcels and related services; and
(iii) mobile prepaid/recharge phones and sim cards;
(iv) gift cards, travel cards, MoneyGram and vouchers;
(v) prepaid tickets including transport tickets (Myki, Opal, Go Card);
(vi) trailer, lawn mower and car hire;
(vii) coin operated vacuums;
(viii) any other products which are legally ineligible for loyalty programs as prohibited by law
(ix) any other products designated as ineligible from time to time.
(b) payment is made by any accepted payment method including cash, most credit and debit cards issued by banks and mobile pay app, if available BUT excluding any payments made using 7-Eleven Fuel Pass, any fleet card, Motorpass, vouchers, free offers and any other excluded payment methods specified in these Terms and Conditions as updated from time to time.
If your payment method is declined and you do not complete the payment, the transaction is not an Eligible Purchase.
“My 7-Eleven app” means 7-Eleven’s mobile application that can be downloaded from the Apple or Google Play app stores.
“7-Eleven Account” means the account created when you download and use the My 7-Eleven app for the first time.
“My Card” means the virtual card you can access in the My 7-Eleven app using the ‘My Card’ button which will be created when signing up for the 7-Eleven Account.
“Velocity Frequent Flyer” means Velocity Frequent Flyer Pty Ltd (ACN 601 408 824)
“Velocity Membership Account/Velocity Account” means the account created when your application to become a member of the Velocity Frequent Flyer program has been accepted and you become a Velocity member.
“Velocity Membership Card” means:
(c) the physical Velocity Frequent Flyer membership card; or
(d) the My Velocity Digital Card that can be found in the Velocity Frequent Flyer app, Virgin Australia App, Members Apple Wallet or third party card storage provider, that are issued to Velocity members.
“Velocity Points” refers to the Points which may be earned and redeemed by Velocity members in accordance with the Velocity membership Terms and Conditions.
“Premium Fuel” means Extra 95 and Supreme+ 98 sold at 7-Eleven stores and other premium fuels designated from time to time.
“Regular Fuel” includes but not limited to the following: Special Unleaded, Special Unleaded E10, Special Diesel, Autogas (LPG) and any new regular fuels sold at 7-Eleven stores.
2. EARNING VELOCITY POINTS
2.1 To earn Velocity Points, you must be a Velocity member and present a valid Velocity Membership Card (or use the My Card in the My 7-Eleven app as described below) when completing a transaction. Velocity membership and Velocity Points earn are subject to the Velocity membership Terms and Conditions, as amended from time to time.
2.2 Use of the My 7-Eleven app is governed by the My 7-Eleven app Terms and Conditions, as amended from time to time.
2.3 In general, Velocity members can earn Velocity Points on Eligible Purchases at 7-Eleven stores by:
(e) swiping their physical Velocity Membership Card or scanning a My Velocity Digital Card - this feature is currently only available in stores located in Western Australia, or
(f) scanning their My Card through the My 7-Eleven app that is linked to a Velocity Membership Account,
in each case, before completing payment for the same transaction.
2.4 7-Eleven customers who are not Velocity members can earn Velocity Points by joining the Velocity Frequent Flyer program and successfully linking their Velocity Membership Account in the ‘Settings’ tab of the app or alternatively (currently only in Western Australia) use their My Velocity Digital Card accessible via the Velocity Frequent Flyer or Virgin Australia app before completing an Eligible Purchase. Details on how to link the accounts are available at www.7eleven.com.au/velocity
2.5 Velocity Members will earn the following Velocity Points on Eligible Purchases at 7-Eleven stores:
(g) 2 Velocity Points per $1 (including GST) spent for in-store products;
(h) 2 Velocity Points per 1 litre of Premium Fuel; and
(i) 1 Velocity Point per 1 litre of Regular Fuel.
2.6 The exact number of Points to be awarded to the Member’s account will be calculated after excluding any products or services which form part of a transaction which are not Eligible Purchases. Fractions of Velocity Points will not be allocated. The total Points awarded on completion of a transaction will be calculated by applying the relevant Points earn rate to the actual number of litres of fuel purchased and the purchase price paid for in-store Eligible Purchases, before rounding the combined Points up to a whole number.
2.7 Velocity members should allow up to 24 hours for Velocity Points to appear in their Velocity Membership Account following an Eligible Purchase.
2.8 No retrospective claims for Velocity Points will be accepted at any time, even in instances where the claim arises out of technology malfunctions.
2.9 If an Eligible Purchase is made and later returned or exchanged, the Velocity Points earned for that purchase may be deducted from your Velocity account.
2.10 It is recommended that you, and your nominated recipients of Velocity Points, seek independent advice from your/their accountant or tax adviser so that any potential tax implications or liabilities, such as fringe benefits tax or income tax, that may arise from the earning and/or redemption of Velocity Points are understood. Any tax implications arising for you or your nominated recipients of Velocity Points are your and/or their sole responsibility and 7-Eleven and Velocity will not be responsible or liable for any taxes as a result of issue, receipt or redemption of Velocity Points.

5. CHANGES TO THESE TERMS AND CONDITIONS
5.1 These Terms and Conditions may be updated from time to time by publishing an updated version on the Velocity and 7-Eleven websites and the My 7-Eleven app. Your continued participation in the 7-Eleven Partner Program following publication of updated Terms and Conditions confirms your acceptance of the updated Terms and Conditions.
5.2 7-Eleven and or Velocity may also seek your confirmation, via the My 7-Eleven app if the accounts are linked, that you agree to the updated Terms and Conditions. You are not required to agree to the changes, but you may not be able to participate in the 7-Eleven Partner Program and earn Velocity Points if you do not agree to them.
6. PRIVACY
6.1 7-Eleven will collect personal information directly from you when you register for a 7-Eleven Account, and when you use the My 7-Eleven App.
6.2 7-Eleven will collect, hold, use and disclose your personal information in accordance with 7-Eleven’s privacy policy available at www.7eleven.com.au/privacy-policy.

6.4 If you link your Velocity Account to your My 7-Eleven app account, Velocity will share some of your personal information with 7-Eleven. Velocity and 7-Eleven may use your personal information for purposes related to your linked accounts, including to:
· check that you’re a member of both programs;
· link your accounts; and
· allow you to access details about your Velocity account, such as your Membership number within the My 7-Eleven app.
You can de-link or manage your linked accounts at any time through “Settings” in your 7-Eleven Account.
7. GENERAL
7.1 If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect.

A. General
1. Information on how to enter this Promotion, mechanics of entry and prizes form part of these Conditions of Entry. Entry into this Promotion is deemed acceptance of these Conditions of Entry by each Entrant.
2. Entry is open to Australian residents residing in New South Wales, Australian Capital Territory, Queensland, Victoria and Western Australia aged 18 years and over (Entrants).
3. The Promoter is Velocity Frequent Flyer Pty Ltd (ACN 601 408 824) of registered address 275 Grey Street, South Brisbane, Queensland 4101
4. The directors, officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate are not eligible to enter this Promotion.
5. The Promotion commences at 00:01 am AEST on 27 May 2021 and ends at 11:59 pm AEST on 2 June 2021 (Promotion Period).
B. Entry
6. To enter the Promotion, Entrants must, during the Promotion Period: (1) successfully link their valid Velocity membership to their My 7-Eleven app account; and (2) complete a Velocity Points-earning transaction at 7-Eleven (an Entry). 9. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Illegible, incomprehensible and incomplete entries will be deemed invalid. C. Drawing Winners
12. The draw will be conducted on 4 June 2021 at 10:00am at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250. All decisions of the Promoter are final and no discussions or correspondence will be entered into by the Promoter. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible Entrant is drawn.
13. The winner or winners (a Winner) will be notified in writing within two (2) business days of the draw and their names will be published on www.velocityfrequentflyer.com on 9 June 2021.
14. A draw for any unclaimed prizes may take place on 15 June 2021 at the same time and place as the original draw, subject to any directions from a regulatory authority.
15. A redrawn Winner, if any, will be notified in writing within two (2) business days of the draw, and in writing within 2 days of draw. The name of any re-draw Winner will be published on www.velocityfrequentflyer.com on 18 June 2021.
16. Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these Conditions of Entry as if the discarded entry had not been received.
17. This is a game of chance and skill plays no part in determining the outcome.
D. Prize
18. There are 25 prizes to be won. The first 25 valid entries drawn will each win two tickets for the 7-Eleven and Velocity Frequent Flyer partnership launch flight VA711 from Sydney to Sydney scheduled for 29 June 2021. If a winner is from Victoria, Queensland or Western Australia, two return economy Virgin Australia flights from the nearest capital city serviced by Virgin Australia will also be provided. Winners must arrange their own accommodation.
19. Total prize value is $22,500 AUD (including GST). The average total prize value is AUD$818.20 (excluding GST), The prizes are not exchangeable, transferrable and cannot be taken as cash.
20. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. The accompanying party to the Winner must be over 12 years of age and the Winner must be the nominated parent/guardian of any person under 18 years of age.
22. Flights are subject to Virgin Australia’s Conditions of Carriage which are located on the Virgin Australia website at www.virginaustralia.com.
23. The flights will be organised with you when contacted by Velocity Frequent Flyer about winning the competition.
24. If for any reason, the Winner does not, once the flights have been booked, notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight at the time stipulated, their prize will be forfeited and cannot be redeemed for cash.
25. The Prize flights will not earn Velocity Points.
26. It is a Winner’s responsibility to ensure that they have requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner.
27. A Winner is responsible for all other expenses including accommodation, spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
28. Prize must be taken on 29 June 2021 and is subject to booking and flight availability. Flights which are taken by the Winner to reach Sydney airport may be taken before 29 June 2021, subject to Virgin Australia’s approval and the Winner will be responsible for any associated accommodation or other costs for arriving to Sydney before, or leaving Sydney after, 29 June 2021.
29. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of the prize.
30. The prize will be awarded to the Entrant named in the entry.
E. Contacting the Entrant
31. Should an Entrant’s contact details change during the Promotion Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
32. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
33. Subject to the unclaimed prize draw clause, if for any reason a Winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter (before 15 June 2021), then the prize (or that element of the prize) will be forfeited.
34. The Promoter reserves the right to request that a Winner provides proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the prize in whole and no substitute will be offered.
F. Intellectual Property
35. Entrants agree that they are fully responsible for any materials they submit via the Promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
a. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
b. their Content shall not contain viruses or cause injury or harm to any person or entity;
c. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
d. the Content is the original artistic and/or literary work of the entrant that does not infringe the rights of any third party;
e. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
f. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the Entrant agrees to indemnify the Promoter for any breach of the above terms.
36. As a condition of entering this Promotion, Entrants hereby assign to the Promoter, all right, title and interest in and to all intellectual property rights (including copyright but excluding moral rights) in any material created pursuant to the Entrant’s participation in any aspect of the Promotion (Works). Entrants acknowledge that the Promoter is free to use the Works and to exercise its rights in relation thereto and the Entrant will not be entitled to any fee for such use. Such use may include social media channels, publications including our inflight magazine, television commercials. Entrants agree they may not be attributed as the author of the Works and that the Promoter may undertake any act or omission in relation to the Works, which may otherwise constitute an infringement of their moral rights.
37. The Promoter may want a Winner to participate in promotional activity after the Promotion has ended. In consideration for the Promoter awarding the prize to a Winner, the Winner permits the Winner’s image and/or voice, as recorded, photographed or filmed during the Winner’s participation in the prize to appear in any media whatsoever throughout the world for an unlimited period and the Winner will not be entitled to any fee for such use.
G. Tax
38. The Promoter will not be liable for any tax liability, including without limitation income tax, fringe benefits tax, or any liability or loss of opportunity due to reportable fringe benefits, incurred by a Winner, an Entrant, and/or another party in regards to any connection with participating in the Promotion or the receipt or use of any prize.
39. Entrants, the Winner and/or another party will be required to pay any taxes and other airport related charges (including any applicable GST on those taxes and charges) which may be due on receipt or use of the prize.
40. It is recommended that you, and your nominated recipients of Points, seek independent advice from your/their accountant or tax adviser so that any potential tax implications or liabilities, such as fringe benefits tax or Income Tax, that may arise from the earning and/or redemption of Points or winning a Prize are understood. Any tax implications arising to you or your nominated recipients of Points or a Prize are your and/or their sole responsibility and 7-Eleven and Velocity Frequent Flyer will not be responsible or liable for any taxes as a result of the issue, receipt or redemption of Points or claiming a Prize
41. The Promoter does not accept responsibility for and makes no representations about any tax liability as a result of participating in the Promotion or from receiving or using any of the prizes.
42. The Promoter, its agents and associate companies are not responsible for and exclude all liability (including negligence), for any variation in the prize value to that stated in these Conditions of Entry.
H. Legal
43. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. The Promoter reserves the right to disqualify a Winner if the Promoter becomes aware that the Winner and/or the Winner’s entry is of a type described in this clause. Any Entrant disqualified under this clause is prohibited from any further participation in the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
44. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant or decline to award the Prize if it believes it cannot determine the identity of the Entrant
45. As a condition of accepting the prize, the Winner(and his/her/their companion must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a Winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
46. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, pandemics, epidemics or act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
47. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to any written direction given under State Regulation.
48. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) in Australia, or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). The Promoter and its associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this Promotion or any prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; (iv) any variation in prize value to that stated in these Conditions of Entry; and (v) acceptance and/or use of any prize (including but not limited to any component of a Winner’s trip).
49. 1. Acceptance this Invitation is deemed acceptance of these Conditions of Entry by you (the Invitee) for yourself and on behalf of the Invitee’s guest (Guest).
2. The host of this event is Velocity Frequent Flyer Pty Ltd (ACN 601 408 824) of registered address 275 Grey Street, South Brisbane, Queensland 4101 (Velocity).
3. Costs associated with attending the event, including costs of travelling to the airport and ancillary expenses are your responsibility.
4. You and your Guest are invited to the 7-Eleven and Velocity Frequent Flyer partnership launch flight VA711 from Sydney to Sydney scheduled for 29 June 2021.
5. This is a money can’t buy invitation (valued at approximately $300 AUD, including GST). The invitation and event tickets are not exchangeable, transferrable and cannot be taken as cash.
6. If you would like to accept this invitation, you must be a Velocity member or sign up to the Velocity Frequent Flyer prior to the tickets being issued. To join the Velocity Frequent Flyer program visit: https://join.velocityfrequentflyer.com. You must RSVP to this invitation by 1 June 2021 will need to provide Velocity with your Velocity Member number when you and name of your Guest when you RSVP.
7. If the event is cancelled for any reason, Velocity, in its discretion, reserves the right to reschedule the event (or that part of the event) with another event to which you will be invited.
8. You must be over 18 to accept this invitation. Your Guest must be over 12 years of age and the if your Guest is under 18 years of age, you must be their parent/guardian.

11. If for any reason, the Invitee does not respond to the Invitation with the requested details by 1 June 2021 this Invitation will be revoked.
12. The event flight will not earn Velocity Points.
13. The event will be held on 29 June 2021.
14. The tickets will be issued to the Invitee and their Guest and these names should match their drivers licence or legal form of identification. For attendees over the age of 18, identification documents may be requested as a condition of entry to the event. In the event that an Invitee or Guest cannot provide suitable proof of identity, entry to the event may be denied.
15. Each of the Invitee and Guest consent to Velocity using their name, likeness, image and/or voice in the event (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by Velocity. By accepting this invitation and presenting tickets for admission to the event, each of the Invitee and Guest consent to same.
16. Each of the Invitee and their Guest agree that they are fully responsible for any materials including but not limited to comments, recordings and images which they may create or contribute to media created in connection with the event (“Content”). Velocity shall not be liable in any way for such Content to the full extent permitted by law. Velocity may remove or decline to publish any Content without notice for any reason whatsoever. Each of the Invitee and Guest warrant and agree that:
a. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
b. their Content shall not contain viruses or cause injury or harm to any person or entity;
c. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
d. the Content is the original artistic and/or literary work of the entrant that does not infringe the rights of any third party;
e. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
f. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the Invitee agrees to indemnify Velocity for any breach of the above terms.
17. As a condition of accepting this invitation to this event and by presenting tickets for admission to the event, each of the Invitee and Guest hereby assigns to Velocity, all right, title and interest in and to all intellectual property rights (including copyright but excluding moral rights) in any material created pursuant to the Invitee and Guest’s participation in any aspect of the Promotion (Works). Invitees and Guests acknowledge that Velocity is free to use the Works and to exercise its rights in relation thereto and the Invitee and Guest will not be entitled to any fee for such use. Such use may include social media channels, publications including our inflight magazine, television commercials. Invitees and Guests further agree that they may not be attributed as the author of the Works and that Velocity may undertake any act or omission in relation to the Works, which may otherwise constitute an infringement of their moral rights.
18. By attending the event, each of the Invitee and Guest consent to Velocity using images and/or voice recordings, as recorded, photographed or filmed during the event to appear in any media whatsoever throughout the world for an unlimited period and neither the Invitee nor Guest will not be entitled to any fee for such use.
19. Velocity will not be liable for any tax liability, including without limitation income tax, fringe benefits tax, or any liability or loss of opportunity due to reportable fringe benefits, incurred by an Invitee or their Guest, in connection with them attending the event. Velocity does not accept responsibility for and makes no representations about any tax liability as a result of attending the event.
20. Velocity, its agents and associated companies are not responsible for and exclude all liability (including negligence), for any variation in the event value to that stated at the time of invitation.
21. If there is a dispute as to the identity of an Invitee or Guest, Velocity reserves the right, in its sole discretion, to refuse to issue tickets to attend or otherwise grant admission to the event.
22. As a condition of accepting the event invitation, the Invitee (and Guest must sign any legal documentation as and in the form required by Velocity in its absolute discretion, including but not limited to a legal release and indemnity form. In the event Guest is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
23. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Velocity’s ability to proceed with the event on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, pandemics, epidemics or act of terrorism, Velocity may in its absolute discretion cancel or reschedule the event.
24. If for any reason this event is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of Velocity, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the event, Velocity reserves the right in its sole discretion to take any action that may be available and to it, and may cancel, terminate, modify or suspend the event.
25. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) in Australia, or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). The Promoter and its associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this event.
